Since 1986, the Division of Administrative Rules (Division) has issued a newsletter to inform rulewriters about current happenings with rules. In 1994, the Division began using E-mail to distribute RulesNews to most rulewriters. Now, with this issue, the Division begins delivering RulesNews using an E-mail ListServ to everyone involved in rulemaking. This has several advantages:

RULEMAKING SEMINARS SCHEDULED

The Division has scheduled four rulemaking seminars and one round-table discussion during the next two months.

On July 23, 2002, the Division will conduct eRules and Rulemaking Process training. Sessions will be held at 8:30, 10:30, 1:30, and 3:30 pm in State Office Building room B108. To register for one of these sessions, notify Sophia Manousakis. Specify the session you would like to attend.

On Wednesday, August 14, 2002, the Division will host a round-table discussion on rulemaking. This session is intended to give agencies an opportunity to discuss issues or concerns related to rulemaking. A portion of the discussion will be devoted to policy and rulemaking, how the two relate, and how they are different within the context of the Utah Administrative Rulemaking Act and case law. To register for this session, notify Sophia Manousakis. NOTE: The Round-Table has been postponed until Wednesday, October 2, 2002.

Those needing special accommodation (including auxiliary communicative aids and services) must notify Ms. Manousakis when making their reservations (at least three working days prior to the seminar).

2002 LEGISLATIVE ACTION AFFECTING RULEMAKING

The 2002 General Session of the Legislature ended on March 6. During the session, the Legislature passed one bill and two resolutions dealing with administrative rules in general.

S.B. 170 "Reauthorization of Administrative Rules" by Sen. Howard Stephenson (R)

This is the Administrative Rules Review Committee's annual bill which is required by Section 63-46a-11.5. In the version of the bill that passed on March 5, 2002, only a portion of one rule from the administrative code--Subsection R501-12-6(B)(2)(d) --was not reauthorized.

In a significant departure from years past, this bill also proposes to not reauthorize policies from Dixie State College, Snow College, Southern Utah University, the University of Utah, Utah State University, Utah Valley State College, and Weber State University that deal with the issue of weapons on campus.

S.B. 170 passed on March 5, 2002, and was signed by the Governor on March 26, 2002. S.B. 170 went into effect May 1, 2002. (UT L 2002 Ch 325)

H.C.R. 2 "Resolution Supporting Businesses" by Rep. Greg Curtis (R)

With this resolution, "the Legislature of the state of Utah recognizes the importance of considering the potential negative impact on the Utah business community in its passage of laws and through state agency rulemaking."

H.C.R. 4 passed on March 5, 2002, and was signed by the Governor on March 15, 2002.

H.J.R. 26 "Resolution Promoting Cooperative Regulatory Environment and Economic Development in Utah" by Rep. Chad Bennion (R)

This resolution "urges the state's regulatory agencies and the Utah business community to work together to develop regulatory strategies that enhance the balance between the need for regulatory protections and the economic needs and challenges faced by the business community."

H.J.R. 26 passed on March 6, 2002, and went into effect on March 6, 2002.

BILLS MAY REQUIRE RULEMAKING ON A HOST OF SPECIFIC ISSUES

As a result of actions taken during the 2002 General Session, 326 bills will become law. Of these, at least 62 (affecting 126 separate statutory sections) modify explicit rulemaking authorizations. The Division of Administrative Rules has prepared the following list of bills to facilitate state agency compliance with legal rulemaking requirements. CHANGES UNDERWAY TO UTAH LAW ON DISC

For over ten years, many state agencies have used a product called UTAH LAW ON DISC for researching Utah law. This summer, LexisNexis™ plans to change the software used to operate the CD. This change has been anticipated for sometime. LexisNexis delayed an earlier transition at the request of several state agencies.

Subscribers to UTAH LAW ON DISC received a dual release version of the spring 2002 CD. One CD operates under the Folio Views software to which subscribers are accustomed. The other CD runs using LivePublish, a product of NextPage, Inc. based in Lehi, Utah. Some state entities, like the Legislature and the Division of Finance, are already using LivePublish to publish state information on their web sites. The Internet version of UTAH LAW ON DISC, which currently uses LivePublish, is available at http://www.michie.com/utahlod/ (NOTE: This site is only accessible from a PC/network using a state-assigned IP address to connect to the Internet.)

The Internet and bi-monthly CD subscription products, produced by LexisNexis™ and available through statewide contract AR-997, contain 16 searchable legal publications including: Utah Code Annotated, Utah Administrative Code Annotated, Utah Judicial Decisions, Utah Court Rules Annotated, Utah Tax Commission Decisions and Advisory Opinions, Utah Executive Documents (Executive Orders and Proclamations), Utah Law Reviews, Utah Session Laws, and Utah Legislative Rules.

The LivePublish version of UTAH LAW ON DISC (CD version) requires an Intel® Pentium®-based 133 MHz computer or equivalent; Microsoft® Windows® 95/98/98SE/2000/ME or Windows NT® 4 sp4; 32 MB of RAM for Windows 95/98/98SE or 64 MB of RAM for Windows ME/NT 4/2000; 50 MB free hard disk space; 800x600 video resolution with 256 color depth (and small fonts); 8x CD-RM drive; Microsoft Internet Explorer 4.01 sp2 or Netscape Navigator 4.0.8 released browser versions only; enabled Java® and JavaScript on the browser; and enabled cookies on the browser.

RULES TO REVIEW IN 2002

Section 63-46a-9 requires each agency to review its rules within five years of each rule's original enactment or last five-year review, and then within five-year intervals. To comply with the review requirement, the agency must submit a FIVE-YEAR NOTICE OF REVIEW AND STATEMENT OF CONTINUATION for each of its rules listed below. Otherwise, the rules will expire. Reviews may be filed ANY TIME prior to the deadline.

With the advent of eRules, when a FIVE-YEAR NOTICE OF REVIEW AND STATEMENT OF CONTINUATION is filed, the text of the rule must be attached. Please contact Mike Broschinsky (801-538-3003) if you need to obtain a current version of your rule.
