The Legislature's Administrative Rules Review Committee (ARRC) met several times during the interim to discuss the issue of policies and rules. At its December 3 meeting, the ARRC directed staff to draft a bill amending the rulemaking act. This bill:
At least in part, the intent of the ARRC in drafting this bill is to broaden the definition of rule creating a class of unenforceable rules. This will enable the ARRC to apply its existing authority to review rules, policy statements, and other documents and to "not reauthorize" those documents if it so chooses. Potentially, this bill may affect advisory opinions, guidance documents, or even web pages.
A copy of the draft bill is attached to this newsletter. The bill will be discussed at the ARRC's next meeting scheduled for December 16 at 3:00 p.m. in room 416.
The Administrative Rules Review Committee is considering other bills as well. One bill modifies a reporting requirement that affects the Department of Commerce, Division of Corporations and Commercial Code. This bill has been approved for filing.
The third bill will amend sections throughout the Utah Code that use the word policy instead of rule. The motion directing staff to prepare this bill was made August 27. A copy is not yet available.
The current version of Rule R15-1 provides in part:
(5) If an agency holds a mandatory hearing under the procedures of this rule during the public comment period described in Subsection 63-46a-4(6), no second hearing is required for the purpose of comment on the same rule or change considered at the first hearing.
The term "mandatory" hearing is used throughout the rule to refer to hearings required by 63-46a-5 or by other law. The Division is considering rewording this paragraph to clarify that an agency may hold a subsequent hearing to one already scheduled as it deems necessary, but that additional hearings are scheduled at the option of the agency regardless of whether the initial hearing was mandatory.
The Division invites comment regarding the change being considered. You may direct comment to Ken Hansen at 801-538-3777. The Division anticipates filing this change for publication in the Utah State Bulletin before the end of January.
eRules sends an E-mail to you when a rule is filed. If you do not receive an E-mail, there may be a problem with the filing and you must contact the Division (801-538-3218) as soon as possible.
If you are planning to be out of the office for any period of time after you file a rule, please call the Division (801-538-3218) and give Nancy the name of an alternative contact to whom we may direct questions.
Section 63-46a-9 requires each agency to review its rules within five years of each rule's original enactment or last five-year review, and then within five-year intervals. To comply with the review requirement, the agency must submit a FIVE-YEAR NOTICE OF REVIEW AND STATEMENT OF CONTINUATION for each of its rules listed below. Otherwise, the rules will expire. Reviews may be filed ANY TIME prior to the deadline.
With the advent of eRules, when a FIVE-YEAR NOTICE OF REVIEW AND STATEMENT OF CONTINUATION is filed, the text of the rule must be attached. Please contact Mike Broschinsky (801-538-3003) if you need to obtain a current version of your rule.
