Legislation Which Affects Rulemaking
During the 2007 General Session, the Legislature passed the following bills affecting administrative rules.
H.B. 64. "Impact of Administrative Rules on Small Businesses." (Rep. S. Clark)
H.B. 64 changes anticipated cost or savings information an agency is required to provide on the rule analysis when it files a proposed rule, change in proposed rule, or emergency rule.
Specifically, agencies must provide anticipated costs or savings to "small businesses" (defined to mean a business employing fewer than 50 people). In addition, agencies must now assess anticipated costs or savings to "persons other than small businesses, businesses, or local governmental entities" instead of "other persons." Look for changes to the rule analysis forms on 06/16/2007. Agencies will still assess overall business impacts under the "comments by the department head on the fiscal impact the rule may have on businesses".

H.B. 327. "State Agency Timely Adoption of Administrative Rules." (Rep. D. Clark)
H.B. 327 requires timely adoption of administrative rules. It amends Section 63-46a-4 and requires an agency to "initiate rulemaking proceedings no later than 180 days after the effective date of the statutory provision that requires the rulemaking." If the agency is unable to file the rule by the deadline, it is required to "appear before the legislative Administrative Rules Review Committee and provide the reasons for the delay."
The Governor signed H.B. 327 on 03/12/2007. H.B. 327 (Chapter 168, Laws of Utah 2007) went into effect on 04/30/2007. S.B. 122. "Administrative Rules Reauthorization" (Sen. H. Stephenson)
This is the Administrative Rules Review Committee's annual bill required by Section 63-46a-11.5. S.B. 122 reauthorized all rules, except a portion of an Education rule -- Section R277-437-1. The Governor signed S.B. 122 on 03/13/2007. S.B. 122 (Chapter 225, Laws of Utah 2007) went into effect on 05/01/2007. Other Legislation recommended by the Legislature's Administrative Rules Review Committee.
The Legislature's Administrative Rules Review Committee recommended two other pieces of legislation that also passed. These bills affect more than one, but not all, rulemaking agencies.
S.B. 32, "Filing of Administrative Rules, Orders, and Regulations" corrected Section 63-5a-7 to make it consistent with the Utah Administrative Rulemaking Act. In part, it provides that rules and orders of state government issued in accordance with Title 63, Chapter 5a, have the full force and effect of law during a state of emergency when a copy of the document is filed with the Division of Administrative Rules. The Governor signed S.B. 32 on 03/12/2007. S.B. 32 (Chapter 177, Laws of Utah 2007) went into effect on 04/30/2007. 1st Substitute S.B. 138, "Administrative Rule Criminal and Civil Penalty Amendments" amends sections throughout the Utah Code. In some cases, sections that provided criminal penalties for violating rules were amended to provide for civil penalties. In other instances, provisions that had previously appeared in rule were incorporated into statute and the criminal penalty was maintained. The Governor signed S.B. 138 on 03/15/2007. S.B. 138 (Chapter 320, Laws of Utah 2007) went into effect on 04/30/2007. Implementing H.B. 64
H.B. 64 changes the rule analysis questions to which agencies respond regarding costs. As part of the eRules reprogramming effort, the new questions will be fully integrated into the system. However, the new version is not yet ready for prime time (or day time, or any time just yet).
To implement H.B. 64's intent by the bill's effective date, the current version of eRules will be slightly modified. For rules filed after 06/15/2007, the forms will be changed. Question 7C on the form that currently asks for anticipated costs or savings to "other persons" will ask for anticipated costs or savings to "Small businesses (fewer than 50 employees) AND persons other than businesses". When the new version of eRules becomes available, this one question will be split into two separate questions. The Division will continue to review responses to all of the costs boxes and apply the standards set by Section R15-4-10, which will be updated to reflect the changes made by H.B. 64.

Implementing H.B. 327
To resolve ambiguity around the meaning of the word "requires" as it is used in the rulemaking act and H.B. 327, the Division amended Section R15-3-5. This amendment states:
For the purposes of Subsection 63-46a-4(11), the phrase "statutory provision that requires the rulemaking" means a state statutory provision that explicitly mandates rulemaking.
The amendment was published in the 03/15/2007, issue of the Utah State Bulletin, and was made effective on 04/30/2007, which is the day H.B. 327 went into effect. The Clock is Ticking -- 133 Days Left to File Rules Explicitly Mandated by Bills Effective on 04/30/2007
Because of the changes made by H.B. 327, agencies must now pay close attention to the effective dates of legislation requiring rulemaking. For legislation effective 04/30/2007 that explicitly mandates rulemaking, agencies must file the implementing rules by 10/27/2007. If an agency is unable to make this deadline, it must then appear before the legislative Administrative Rules Review Committee to explain the delay.
For bills effective on 07/01/2007, agencies have until 12/28/2007, to file rules explicitly mandated by a bill.
Changes to eRules Funded
Finally, eRules is being reprogrammed. The Legislature appropriated one-time funding to update the application agencies use to file rules, and that the division uses to publish rules. The eRules application went online 09/01/2001. For some time now, it has been showing its age (but haven't we all?). Employees from the Department of Technology Services are doing the development work for the new version. The effort is well into the design phase. Statutes Imposing a Criminal Penalty for Violating a Rule, Part II
In 2005, the Administrative Rules Review Committee looked at statutes that authorized criminal penalties for violating a rule. Back then, the Committee decided that to tackle the issue in two parts. With input from agencies, the Committee identified those provisions for which the criminal penalties could be eliminated without creating major concern or disruption. This bill finally passed during the 2007 General Session (see "Legislation Which Affects Rulemaking" in this newsletter).
At its 06/12/2007 meeting, the Administrative Rules Review Committee voted to take a different approach with the remaining provisions. With a unanimous motion, the Committee directed its chairs to send a letter to the appropriate interim committee chairs. The letter will express concern for statutory provisions that impose a criminal penalty, especially those that provide for a felony, for violating a rule.

Rep. Ben C. Ferry, Republican from District 2, has been assigned as the House chair of the Legislature's Administrative Rules Review Committee. Rep. Ferry has served in the House since 1999. Before Filing That Large Rule ...
Stop! Read this! Rule text that is over 60 kilobytes (roughly four pages) in size has a high probability of crashing eRules. Check the size of the file (you can do this by navigating to the file using My Computer in Windows, selecting it, and viewing the file details).
For large text, follow this procedure: 1) create a file containing the words "This is a placeholder for the text for RXXX-YYYY"; 2) save this file in RTF, and upload it with the rule analysis; and 3) send an email message with the real text attached to the Rules e-mail box (rules "at" utah.gov).
Incorporation by Reference: Agency Responsibilities
Recently, one of the Division's editors took a call from a citizen. He said he had called an agency looking for information about a specific requirement. The citizen said he was given a rule number, the name of a publication that had been incorporated by reference in the rule, and told to call the Division of Administrative Rules to find it. The Division responded to this call and made available to the citizen the material requested.
Since 1985, the Rulemaking Act has provided basically the same requirement regarding the responsibly for providing access to rules:
(1) Each agency shall:
(a) maintain a current version of its rules; and
(b) make it available to the public for inspection during its regular business hours.

(7)(a) Each agency may enact a rule that incorporates by reference:
(i) all or any part of another code, rule, or regulation . . . ;

(d) The agency shall maintain a complete and current copy of the referenced material available for public review at the agency and at the division. (Section 63-46a-3; emphasis added)
The underlying expectation is that both the agency and the Division of Administrative Rules must be able to provide access to current rules and incorporated materials. The Division appreciates your efforts to respond to requests you receive about your agency's rules.
Who's Checking Those Citations?
Question: Who checks the statutory citations in your rules? Answer: You do. While staff at the Division of Administrative Rules checks that you have provided references to the statute, we do not verify that you have provided the correct citation.
E-mailing the Division of Administrative Rules
Please send e-mails regarding rules to rules "at" utah.gov (or "Administrative Rules" in the GroupWise address book). Staff constantly monitors this mailbox. Sending rules-related e-mail to the Administrative Rules mailbox will prevent delays that may occur if a staff member is out of the office for an extended period. Thanks!
Rules Due for Review in 2007
Section 63-46a-9 requires each agency to review its rules within five years of each rule's original enactment, and then within five-year intervals. To comply with the review requirement, the agency must submit a "Five-Year Notice of Review and Statement of Continuation" for each of its rules listed below. Otherwise, unreviewed rules will expire, become unenforceable, and will be removed from the Utah Administrative Code. Reviews may be filed ANY TIME prior to the deadline.
When filing a "Five-Year Notice of Review and Statement of Continuation," eRules requires that a copy of the rule text (no underlining or strike-out) be attached. Current rule text in RTF format is available from http://www.rules.utah.gov/publicat/code.htm. You may also contact Nancy Lancaster (801-538-3218) or Mike Broschinsky (801-538-3003) to obtain a current version of your rule.
We strongly encourage agencies not to wait until the due date to file a five-year review. If there is a problem filing on that day, agencies could lose rules because the deadline was missed.
The Division sends quarterly E-mail notices to agencies of rules due for review. As of 06/12/2007, the following rules are due for review before the end of 2007.
