Introduction
The Utah Administrative Rulemaking Act creates a joint legislative committee called the Administrative Rules Review Committee (ARRC) to oversee agency rulemaking. The ARRC examines rules to determine: (i) whether they are authorized by statute; (ii) whether they comply with legislative intent; (iii) their impact on the economy and the government operations of the state and local political subdivisions; and (iv) their impact on affected persons. See Section 63G-3-501. The ARRC is authorized to meet at least monthly. Issues are brought to its attention by constituents, the public at large, other legislators, its staff, or its members.
The ARRC has no direct power to delay or change an administrative rule. However, the ARRC can report its findings to the Legislature which in turn may take any number of actions. The ARRC may also exclude rules, or portions of rules, from the annual reauthorization of administrative rules. If an administrative rule is not reauthorized, it may not be enforced after May 1. See Section 63G-3-502.
The ARRC is comprised of ten legislators -- five senators and five representatives; six from the majority party and four from the minority party.
