Introduction

The Utah Administrative Rulemaking Act creates a joint legislative committee called the Administrative Rules Review Committee (referred to hereafter as ARRC) to oversee the carrying out of legislative mandates through the rulemaking process. Section 63-46a-11. The committee usually meets twice monthly from April to December to discuss proposed and effective rules brought to its attention by constituents, the public at large, other legislators, its staff, or its members.

The ARRC has no direct power to delay or change an administrative rule. However, the ARRC can report its findings to the Legislature which in turn may amend, revoke, or otherwise change an agency's regulatory authority if the body finds such action justifiable. The ARRC may also exclude rules from the annual reauthorization of administrative rules.  If an administrative rule is not reauthorized, it may not be enforced after May 1. Section 63-46a-11.5.

The ARRC is comprised of ten legislators--five senators and five representatives; six from the majority party and four from the minority party.
