RULE ANALYSIS |
Purpose of the rule or reason for the change: |
|
The purpose of this rule amendment is to define where Motorized Transportation Devices (MTDs) that are now part of Rule R651-626 may operate within state parks.
|
Summary of the rule or change: |
|
MTDs that are powered by electric motors may be used for transportation to and from facilities and structures within state parks.

State statutory or constitutional authorization for this rule: |
|
Sections 41-22-10 and 63-11-17

Anticipated cost or savings to: |
the state budget: |
|
Since this is a definition of where an MTD may travel, there are no anticipated costs or savings to the State budget.

local governments: |
|
Local government will have no aggregated anticipated costs or savings as this is a definition within state parks that will not affect local government.
|
other persons: |
|
This new section allows the recreating public to access facilities and structures within the state parks by using an MTD (electric motor) within state parks. There are no anticipated costs or savings to other persons because it is a definition.

Compliance costs for affected persons: |
|
This amendment gives more freedom to those needing MTDs to get around and defines where they may use them and that they are powered by electricity.

Comments by the department head on the fiscal impact the rule may have on businesses: |
|
No negative fiscal impact on businesses is anticipated. It is possible that the clarification of the rules surrounding MTD use within state parks will lead to a modest broadening of the user base for these facilities, a result that would benefit local businesses.
