NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is required by Section 36-11-404. This section specifically directs the Lieutenant Governor to make rules that provide for: 1) the appointment of an administrative law judge to adjudicate alleged violations of the lobbyist statutes; and 2) procedures for license applications, disapprovals, suspensions, etc.

 

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The Lieutenant Governor's Office has not received any comments on this rule since it was originally adopted.

 

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule outlines procedures for the Lieutenant Governor's Office to follow when processing lobbyist license/registration applications. This rule also outlines procedures for handling complaints regarding violations of the lobbyist laws and rules. The procedures set forth in this rule have worked fine for the Lieutenant Governor's Office and for lobbyists, and therefore, this rule should be continued.
