RULE ANALYSIS

Purpose of the rule or reason for the change:

The purpose of the rule change is to adopt the Triennial Edition of American Society of Mechanical Engineers (ASME) 2004 Boiler and Pressure Vessel Codes and the National Board Inspection Code (NBIC) (NB-23).

Summary of the rule or change:

The purpose of the rule change is to adopt by reference the following: ASME Section I Rules for Construction of Power Boilers, published July 1, 2004; ASME Section IV Rules for Construction of Heating Boilers, published July 1, 2004; ASME Section VIII Rules for Construction of Pressure Vessels, published July 1, 2004; and ASME B31-1 Power Piping Rules for Pressure Piping, published August 16, 2004. The proposed rule also adopts by reference the NBIC (NB-23), issued December 31, 2004.

Anticipated cost or savings to:

the state budget:

There is a cost of $1,355 for the purchase of the ASME publications for the Division of Administrative Rules. The ASME provides one set of the publications free to the Safety Division. The NBIC provides their publication at no cost. Other than the cost mentioned, there should be no cost or savings to the State budget because these publications incorporate into one volume the addenda and previous edition of the rules that have already been adopted.

The substance of the ASME and NBIC codes are already in effect by virtue of the Labor Commission's previous adoption of various interim addenda and supplements. Consequently adoption of the most current compilation will have no fiscal impact on businesses.

R616-2-3. Safety Codes and Rules for Boilers and Pressure Vessels.

The following safety codes and rules shall apply to all boilers and pressure vessels in Utah, except those exempted pursuant to Section 34A-7-101, and are incorporated herein by this reference in this rule.

A. ASME Boiler and Pressure Vessel Code (200[1]4).

1. Section I Rules for Construction of Power Boilers published July 1, [2001 and 2003 Addenda published July 1, 2003]2004.

2. Section IV Rules for Construction of Heating Boilers published July 1, [2001 and 2003 Addenda published July 1, 2003]2004.

3. Section VIII Rules for Construction of Pressure Vessels published July 1, [2001 and 2003 Addenda published July 1, 2003]2004.

B. Power Piping ASME B31.1 (200[1]4), issued [December 10, 2001 and ASME section B31-1a 2002 Addenda, issued September 20, 2003]August 16, 2004.

C. Controls and Safety Devices for Automatically Fired Boilers ASME CSD-1-1998; the ASME CSD-1a-1999 addenda, issued March 10, 2000; and the ASME CSD-1b (2001) addenda, issued November 30, 2001.
