This rule is authorized by Section 26-1-5 that grants the Utah Department of Health the power to adopt, amend, or rescind rules that shall have the force and effect of law. In addition, Section 26-18-3 requires the Department to administer the Medicaid program. Furthermore, 42 USC 1396n(c) authorizes the Department to administer home and community based services by waiver.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any: |
|
This rule should be continued because it implements all home and community based waivers that provide community based alternatives to institutional care; currently enables over 5,000 Medicaid clients to either postpone or prevent the need to go into nursing homes; and provides a financial cost savings to the state.
