NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsections 31A-2-201(1) and 31A-2-201(3)(a) provide general rulewriting authority to the commissioner to adopt rules that will implement provisions of the insurance code. This rule focuses on the requirements for a rate service organization filing loss cost factors for property and casualty insurers as specified in Sections 31A-19a-203 and 31A-19a-205.

 

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The department has received no written comments regarding this rule in the past five years.

 

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

It is important that this rule continue in force. It is a key component in the regulation of loss cost filings developed by rate service organizations such as the National Council on Compensation Insurance (NCCI), Insurance Services Office (ISO) and other rating organizations licensed to do business in Utah. This rule applies to all lines of property and casualty insurance coverages.
