NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 19-4-104(1)(a)(iv) authorizes the Drinking Water Board to adopt this rule which governs the protection of surface water sources of drinking water.

 

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received that either oppose or support this rule.

 

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The continuation of this rule is needed because it establishes practices deemed necessary by the Drinking Water Board to protect developed surface water sources of drinking water from pollution or the potential for pollution.
