NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Title 19, Chapter 4, Safe Drinking Water Act, gives the Drinking Water Board the authority to promulgate rules that govern the construction of facilities and quality of water provided by public water systems. Subsection 19-4-104(2) authorizes the Board to adopt and enforce standards and establish fees for certification of operators of any public water system.

 

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received by the Division on this rule.

 

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The continuation of this rule will help to ensure that the individuals involved in operating drinking water systems are and remain competent to do so. This effort will greatly assist in protecting the quality and safety of the drinking water from the source through vast distribution systems to the end consumer, the public. The certification of operators is required by the United States Environmental Protection Agency and is required to retain primacy for the drinking water program.
