NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

The Department of Public Safety is mandated under Section 53-11-101 with the responsibility of issuing license for persons wishing to work as bail bond recovery and enforcement officials in the State of Utah. This statute also mandates the Commissioner of Public Safety to make any rules necessary to administer this license.

 

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

 

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

There is no language in statute which defines the appeal process, and this rule clearly define the process. Without the rule, the Commissioner of Public Safety would have to personally conduct each appeal. Therefore, this rule should be continued.
