NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 53A-13-101(1)(c)(ii)(B) directs the State Board of Education to develop a rule that provides for local school boards to adopt State Board of Education recommended instructional materials or other instructional materials provided for in this rule.

 

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

 

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

It is necessary to continue this rule because state law provides that the State Board of Education have a rule in place, and because it is important to have a rule that provides general provisions and procedures for designation of State Board, school district, and individual educator responsibilities when providing instruction in human sexuality.
