Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule provides the administrative and procedural rules necessary to administer the state and federal programs under the Employment Support Division. Section 35A-1-303 provides the authority to adopt rules governing adjudicative procedures. Section 35A-1-104 authorizes the Department of Workforce Services to adopt rules. Subsection 35A-1-104(4) authorizes the Department to establish eligibility standards for its programs.

No written comments have been received since the last five year review.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule is necessary to administer the programs under Section 35A-3-101 et seq. If the rule did not exist, the Department would have no procedures to follow in determining eligibility, preserving client privacy, following the several state and federal laws affecting our programs, or how to resolve disputes between the Department and our customers.
