This is a federally-funded program but the regulations give the states options and the federal government sometimes allows waivers. This rule explains the waivers given to Utah and options taken by Utah. Section 35A-1-104 authorizes the Department of Workforce Services to adopt rules. Subsection 35A-1-104(4) authorizes the Department to establish eligibility standards for its programs.

No written comments have been received during the last five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule is necessary to establish which options have been taken by the Department and which waivers have been given by the federal government. Without the rule, the public would not know which waivers or options are in effect.
