NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Under Sections 23-14-18, 23-14-19, and 23-15-7, the Wildlife Board is authorized and required to provide rules to regulate and prescribe the means by which protected wildlife and aquatic wildlife may be taken.

 

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

Any comments received in opposition to the rule are resolved using existing policies and procedures or the issue is placed on the Regional Advisory Council's and Wildlife Board's agenda for review and discussion during the process for taking public input. The public is welcome to view the Regional Advisory Council minutes, the Wildlife Board minutes, and the administrative record for this rule at the Division of Wildlife Resources. Changes made since the last five-year review include things such as allowing lifetime license holders to participate in the Dedicated Hunter Program, apply for or obtain general deer preference points or permits through the big game drawing, and deleting reference to lifetime license holders applying for remaining general buck deer permit in the big game drawing. Other changes were made to add consistency and clarify the rule.

 

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R657-17 provides the procedures, standards, and requirements applicable to lifetime hunting and fishing licenses. The provisions adopted in this rule are effective in providing the standards and requirements for administering the lifetime hunting and fishing license program. Continuation of this rule is necessary for continued success of the program.
