NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Under Sections 23-14-18 and 23-14-19, the Wildlife Board is authorized and required to provide rules to regulate and prescribe the means by which protected wildlife may be taken.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The division of Wildlife Resources and the Wildlife Board have received several comments, both in support and opposition to Rule R657-5. Rule R657-5 is reviewed at least annually, since it addresses the complex issue of big game hunting. Any comments received in opposition to the rule are resolved using existing policies and procedures or the issue is placed on the Regional Advisory Council's and Wildlife Board's agenda for review and discussion during the process for taking public input. The public is welcome to view the Regional Advisory Council minutes, the Wildlife Board minutes, and the administrative record for this rule at the Division of Wildlife Resources. Changes made since the last five-year review include things such as allowing additional permits being reserved for youth hunters, allowing for additional hunting opportunities in general, firearm provisions and clarification of definitions, reporting requirements, and application procedures. Provisions were also added to address issues related to Chronic Wasting Disease (CWD). Other changes were made to add consistency and clarity to the rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R657-5 provides the application procedures, standards and requirement for taking big game. The provisions adopted in this rule are effective in providing the standards and requirement for taking big game. Continuation of this rule is necessary for continued success of the big game program and providing big game hunting opportunities.
