NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 53A-16-101.5(3)(c) allows the State Board of Education to adopt rules regarding the time and manner in which the student count shall be made for allocation of school trust lands funds.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

It is necessary to have a rule that provides procedures for the State Office of Education to follow when distributing School LAND (Learning and Nurturing Development) Trust Program monies and for school districts to follow when receiving School LAND Trust Program monies. Without the specific procedures, the monies could not be distributed consistent with state law. Additionally, there is significant legislative attention to this issue and Legislators would be concerned if the rule were not continued.
