Subsection 63-46b-4(1) and Section 63-46b-5 of the Utah Administrative Procedures Act authorizes agencies to enact rules to designate categories of adjudicative proceedings as informal proceedings, and to enact rules to prescribe procedures for those informal adjudicative proceedings.

This rule is necessary to enable the Division of Real Estate to conduct some of its adjudicative proceedings on an informal basis. Therefore, this rule should be continued.
