This rule is authorized by Section 63-46b-21, which requires agencies issue a rule that provides for filing a petition for a declaratory order.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is needed because it provides the public with the requirements which govern the submission, review, and disposition of petitions for declaratory orders made to the Department. Therefore, this rule should be continued.
