Subsection 31A-2-201(3)(a) authorizes the commissioner to make rules to implement the provisions of Title 31A. Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The department has not received any written comments regarding this rule in the past five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule goes into detail regarding the minimum standards that must be covered under health care insurance. It includes diabetes education when an individual develops Type 1 and/or Type 2 Diabetes. As new types of care are developed and as a person's health status changes, the rule allows for instruction on how to eat and exercise and handle the overall illness specific to the individual. Therefore, this rules should be continued.
