NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Title 73, Chapter 18, states, "It is the policy of this state to regulate and promote safety for persons and property in and connected with the use, operation and equipment of vessels and to promote uniformity of laws and to adopt and pursue an educational program in relation thereto." In order to accomplish these goals, terms used most frequently in the rules on boating and vessels need to be defined for users of Utah waters.

 

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

 

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Definitions of terms needs to be continued in order to alert and educate the recreational user of state properties and facilities. This will help protect state parks and their natural and cultural resources from misuse or damage. Such items could include watersheds, park amenities, wildlife and flora and fauna. The board is given the authority to make rules for the public to follow.
