NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Section 64-13-10 and Subsection 64-13-17(3) which require the Department to provide programs and facilities, as necessary, to accomplish its purposes. Facilitating the sending and receiving of inmate mail, while maintaining the safety and security of the facility, inmates, and staff are included in this responsibility.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no written comments received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule should be continued because it has provided a safe and secure way of processing inmate mail.
