Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
The provisions of this rule are authorized by grants for rulemaking authority under Sections 72-1-201 and 72-7-102. Specifically, Section 72-7-102 says, "a highway authority having jurisdiction over the right-of-way may allow excavating, installation of utilities and other facilities or access under rules made by the highway authority and in compliance with federal, state, and local law as applicable."

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The department needs this rule in order to advise the public of its access management methodology. Therefore, this rule should be continued.
