The provisions of this rule are authorized under Sections 72-7-102 through 72-7-104. A highway authority having jurisdiction over the right-of-way may allow excavating, installation of utilities, and other facilities or access under rules made by the highway authority and in compliance with federal, state, and local law as applicable.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The department continues to have a need to regulate bus shelters and bus benches because they often can infringe on right-of-way. Therefore, this rule should be continued.
