NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Subsection 53-6-105(k). This subsection describes the duties of the director of the Police Academy. This gives the Director the authority to make administrative rules.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

Peace Officer Standards and Training (POST) has not received any comments in support or opposing this administrative rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule outlines the necessary requirements for an individual who requests to reactivate or waive the POST basic training test in order to become certifiable in the State of Utah. It also gives rules and guidelines for officers whose certification has become lapsed or inactive. Therefore, this rule should be continued.
