Subsection 53C-1-201(3)(e) permits the agency to be exempted from the Utah Procurement Code upon board approval and adoption of alternative procurement procedures. This rule provides the alternative procedures for the agency to follow when procuring goods and services related to the administration of the agency or management, development, leasing, or sale of trust lands.

This rule is necessary for the agency to be exempt from provisions under Title 63, Chapter 56, Utah Procurement Code. The rule streamlines the procurement process, enabling the agency to respond to market opportunities in a more timely manner. Therefore, this rule should be continued.
