Subsection 26-1-30(2)(m) charges the Department of Health to set and enforce standards for laboratory services.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule provides standards for the approval of laboratories that conduct examinations to determine blood alcohol levels. It is necessary for law enforcement to conduct blood alcohol testing. Therefore, this rule should be continued.
