NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 53-7-204 authorizes the Utah Fire Prevention Board to enact rules for the prevention of fire and for the protection of life and property in an assisted living facility.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

Rule R710-3 has been amended four times since the last five-year review in 2002. There have been no written comments received from these four amendments. It is the policy of the Utah Fire Prevention Board to notify everyone affected by the proposed amendments and invite them to the Board meetings to resolve any concerns before the proposed rule is filed with the Division of Administrative Rules. This usually eliminates the need for written comments to a Board administrative rule action.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R710-3 is the administrative rule that provides a minimum degree of fire and life safety for those people who reside in and are provided a protected living arrangement on a daily basis because of physical and/or mental incapacitation that prohibits a fully independent lifestyle. This rule needs to be continued due to the dependent needs these clients have on those that provide them care and assistance and the inability of the clients to provide full protective care for themselves.
