NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 64-13-21 provides the authority for this rule. That section directs the Department of Corrections to establish standards for the supervision of offenders specifically under Subsection 64-13-21(1)(b)). These standards are to be established by administrative rule.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no written comments received since the last five-year review.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The rule should be continued because it provides the standards for implementing Section 64-13-21, and details a $30 Supervision Fee payable by offenders under the supervision of the Utah Department of Corrections, and the conditions under which the fee may be waived.
