NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is adopted pursuant to the rulewriting authority granted to the Division pursuant to Section 13-2-5, which provides that the Division may issue rules to administer and enforce the chapters listed in Section 13-2-1, including the Health Spa Services Protection Act.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

In January 2007, the Division received one written comment opposing a proposed rule change which would require, among other things, that health spas place the three-day right of rescission on the first page of the contract. No other written comments have been received since this rule was last reviewed.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is promulgated by the Division to help in the administration of the Health Spa Services Protection Act. The rule provides, among other things, definitions to terms, requirements for registration, and information concerning rescission. The need for the rule continues to exist. Therefore, the rule should be continued.
