Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 62A-4a-403 requires all persons report child abuse. Sections 63-46a-3 and 35A-1-104 authorize the Department to make rules. This rule prohibits providers from abusing, neglecting, or exploiting any Department client who is a vulnerable adult or child. Those providers are acting on behalf of or paid by the Department.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
The Department has not received any comments since the last five-year review.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Without this provision, it would be more difficult to end a contract with a provider who is clearly in violation of the law and explains to providers what is considered exploitation, abuse, and neglect under the code. Therefore, this rule should be continued.
