Section 26-1-5 grants the Department of Health the power to adopt, amend, or rescind rules that shall have the force and effect of law. In addition, Section 26-18-3 requires the department to administer the Medicaid program through administrative rules.

No written comments have been received regarding this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is necessary because it provides rate calculations for nursing facilities and intermediate care facilities for the mentally retarded. It also provides other reimbursement details for these providers. Therefore, this rule should be continued.
