Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Section 26-1-5 grants the Department of Health the power to adopt, amend, or rescind rules that shall have the force and effect of law. In addition, Subsection 26-18-3(4) requires the department to provide disciplinary measures and sanctions for Medicaid providers who fail to comply with the rules and procedures of the Medicaid program. Further, 42 CFR Chapter IV, Subchapter C, Part 455, requires the department to investigate fraud, and if necessary, to impose sanctions against providers.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule is necessary because federal law requires the Medicaid program to implement sanctions against providers who engage in fraudulent practices. This rule also helps to promote quality service and integrity within the Medicaid program. Therefore, this rule should be continued.
