Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
This rule is enacted under the authority of Subsection 63A-5-103(1)(e), which directs the Utah Building Board to make rules necessary for the discharge of duties of the Division of Facilities, Construction and Management (DFCM); Subsection 63A-5-103(1)(f), which requires the Utah Building Board and DFCM to establish standards and procedures to ensure that state-owned facilities are life cycle cost effective; and Subsection 63A-5-206(8), which requires the DFCM director to ensure that state-owned facilities are life cycle cost effective.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
DFCM and the Utah Building Board have not received written comments either in support or opposition to Rule R23-6.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Rule R23-6 implements the statutory provisions and establishes policies and procedures, under the authority of the Utah Building Board, to ensure that state-owned facilities are life cycle cost effective. Therefore, this rule should be continued.
