NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is enacted under the authority of Subsection 63A-5-103(1)(e), which directs the Utah Building Board to make rules necessary for the discharge of duties of the Division of Facilities, Construction and Management (DFCM).

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

DFCM and the Utah Building Board have not received written comments either in support or opposition to Rule R23-24.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Rule R23-24, under the authority of the Utah Building Board, establishes policy provisions relative to projects that are funded partially or totally by non-appropriated funds; requirements for verification of funding; and timing of reimbursements to the DFCM for expenditures made. Therefore, this rule should be continued.
