NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 53A-1-401(3) allows the Utah State Board of Education to adopt rules in accordance with its responsibilities; and Subsection 53A-1-402(3) permits the Utah State Board of Education to administer funds made available through programs of the federal government.

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Upon review of this rule, it has been determined that the rule is no longer necessary. Any requirements relating to withholding payments and commodities in the Child and Adult Care Food Program (CACFP) are provided for in federal law and regulations. The rule will be continued so it will not expire and then will be processed for repeal.
