Section 26-1-5 grants the Department of Health the power to adopt, amend, or rescind rules that shall have the force and effect of law. Section 26-18-3 requires the Department of Health to implement the Medicaid program through administrative rules.

No written or oral comments have been received regarding this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is important because it enforces the necessary standards for nursing homes and for Medicare and Medicaid to pay for services to nursing home residents. This rule also enables more third-party collections and reduces Medicaid nursing home payments. Therefore, this rule should be continued.
