NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 26-1-5 grants the Department of Health the power to adopt, amend, or rescind rules that shall have the force and effect of law. Section 26-18-3 grants the department the authority to implement the Medicaid program through administrative rules. In addition, 42 CFR 435.952 requires the agency to independently verify client information to determine Medicaid eligibility.

No written or oral comments have been received regarding this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is necessary because it establishes requirements for medical assistance applications, eligibility decisions, and improper medical assistance. Therefore, this rule should be continued.
