Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
As specified in Subsection 19-2-104(3)(q), the Air Quality Board may "meet the requirements of federal air pollution laws". Nationwide reductions of mercury (Hg) emissions from certain coal-fired electric generating units are required by 40 CFR Part 60, subparts B and HHHH, and by the Designated Facilities Plan for coal-fired electric generating units, incorporated by reference at Section R307-220-5. Rule R307-224 regulates mercury emissions from any coal-fired electric generating unit as defined in 40 CFR 60.24.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
Rule R307-224 was amended once since its creation under DAR No. 30704. No comments were received on that amendment. No other comments have been received since the creation of Rule R307-224.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Rule R307-224 is required by 40 CFR Part 60, subparts B and HHHH. Therefore, this rule should be continued.
