Section 34A-1-104 gives the Labor Commission authority to establish rules to administer and enforce all laws for the protection of the life, health, and safety of employees.

No written comments have been received during and since the last five-year review of this rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

In light of the commission's continuing responsibility to ensure the protection of life, health, and safety of employees it remains necessary for the commission to address issues relating to the safety of employees in coal mine operations so this rule should be continued.
