NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 63-11-17 allows the board to make rules for the governing of the state park system and for public safety issues as well. This rule prohibits children under the age of 16 to go unsupervised in the state park system.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

For safety reasons for children under the age of 16 who could be lost or could be hurt and for those children under the age of 16 who could be creating mischief or damage to natural and cultural resources, this rule should be continued to define that any child under the age of 16 must be supervised.
