NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 63-11-17 allows the board to make rules to govern the use of the state park system. This rule addresses unclaimed personal property, impounded property, lost and found articles, and the impounding of a vehicle.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Unclaimed personal property will be handled in accordance with Title 77 of the Utah Code. Whenever property interferes with the safe or orderly operation of a park, the property may be impounded. Lost and found articles will be deposited by the finder at the park area office. The impounding of a vehicle shall be in compliance with Title 41, Chapter 1a. This rule combines all of these items under Unattended Property and refers to different sections of the code to define the use. Therefore, this rule should be continued.
