NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Section 53-3-903 which states the division shall develop standards for and administer the Motorcycle Rider Education Program and the division shall make rules to implement the Motorcycle Rider Education Act.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

The division has not received any written comments during and since the last five-year review from interested persons supporting or opposing the rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is still needed because there are several businesses that offer Motorcycle Rider Education, and with the increasing costs of gasoline, more people are choosing to ride motorcycles and are taking the opportunity to complete a motorcycle rider education program. Therefore, this rule should be continued.
