Administrative Rules’ Has a New Web Design

On December 21, 2012, the Division of Administrative Rules rolled out a newly designed web site.  This new look is part of a department-wide effort.  Thanks to UII for their design work.

The Good, the Bad, and the Ugly of Administrative Rules

The Utah State Bar Administrative Law Section is hosting a lunch to discuss Utah administrative rules.  The title for this event is “Administrative Rules: The Good, the Bad, and the Ugly”.

Note on the Passing of Former Administrative Rules Program Manager

It is with sadness that the Division of Administrative Rules notes the passing of Ruth Langheinrich.  Ruth worked for the Utah State Archives for 17 years beginning in November 1967.  During the last several years of her career with Archives, she served as the coordinator of publications which included the State of Utah Bulletin (predecessor to today’s Utah State Bulletin; rulemaking was under the purview of Archives until 1987).

Around 1978, Ruth oversaw a staff of approximately 6 employees who used IBM Selectric Composers — re-keying much of the information submitted for publication — to produce the twice-monthly Bulletin.  Between 1978 and 1984, Ruth also oversaw the introduction of computers to produce rulemaking publications.  The July 1, 1984, issue of the Bulletin was the last issue for which Ruth was responsible.

Ruth was loyal, dedicated, and personally vested in producing accurate publications for the the citizens of Utah.  Her friendly disposition, kind smile, and gentle German accent made her a pleasure to know.  Ruth’s efforts, and those of her staff, made Utah’s administrative rules accessible.  Thank you, Ruth, for your efforts on behalf of Utah’s citizens.

Administrative Rules’ Office Hours Scheduled to Change

Starting Tuesday, September 6, 2011, the Division of Administrative Rules will return to a five-day, eight-hours per day work week.  The Division will be open for business Monday through Friday, from 8 AM to 5 PM.  As always, because of the Division’s strict publication schedule, please call 801-538-3764 to schedule an appointment if you need to meet with a member of the staff.

This change in schedule is made in compliance with H.B. 328 (2011) and the Governor’s directive.  For context, see “Administrative Rules New Office Hours“;  Governor Herbert’s December 9, 2009, press release entitled “Governor Extends Four-Day Workweek, Extends Services in Targeted Areas“; and the Legislative Auditor General’s “Report 2010-10: A Performance Audit of the Working 4 Utah Initiative“.

August 27 Memorial Service Planned for Rep. Buffmire

We notified readers several months ago of the passing of Rep. Judy Ann Buffmire.  Rep Buffmire had served on the Utah Legislature’s Administrative Rules Review Committee from 1993 to 2004.  On 08/18/2011, the Salt Lake Tribune reports that a memorial service to honor Rep. Buffmire has been scheduled for 08/27/2011 at 3 PM in the Utah State Capitol Rotunda.  More information is available in the Salt Lake Tribune article at http://www.sltrib.com/sltrib/politics/52405244-90/utah-buffmire-lawmaker-former.html.csp.

Time to Change those Business Hours Rules

Back in 2008, rules from around state government were amended to accommodate “Working 4 Utah” — Governor Huntsman’s initiative to save energy by changing the work week to four ten-hour days.  With the passage of H.B. 328 (2011) and Governor Herbert’s directive to return to five eight-hour days with business hours from 8 AM to 5 PM beginning the first full pay period in September, agencies need to review their business hour rules once again.  Agencies should file any amendments necessary to return to a five-day work week as soon as possible.  Rules filed by 07/15/2011 will appear in the 08/01/2011 issue of the Bulletin and may be made effective on 09/07/2011.

Former Member of Administrative Rules Review Committee Dies

Judy Ann Buffmire, who represented District 35 from 1993 through 2004 in the Utah House of Representatives, passed away on May 28, 2011.  Rep. Buffmire served on the Legislature’s Administrative Rules Review Committee from 1999 through 2004.  The Division of Administrative Rules gratefully acknowledges and remembers her years service to the state of Utah and its citizens.

Thank You Rep. Gowans and Sen. Goodfellow

The Division of Administrative Rules gratefully acknowledges the service of two members of the Legislature’s Administrative Rules Review Committee.  Rep. Jim Gowans (D, district 21) has served on the committee since 1997.  He was first elected to the Utah House of Representatives in 1993.

Sen. Brent Goodfellow (D, district 12) served on the committee briefly in 2005, and then was reappointed in 2009.  He was first elected to the Legislature as a member of the House of Representatives in 1985.

Both will be leaving legislative service as the next Legislature is sworn in.  The Division of Administrative Rules acknowledges their combined 42 years of service to the people of Utah and 15 years of service on the Administrative Rules Review Committee.  We wish Rep. Gowans and Sen. Goodfellow success in their future endeavors.

Laws of Utah Digitized

The Utah State Law Library reports that the Laws of Utah have been scanned and are now available online (http://pioneer.utah.gov/research/databases/utahlaws.html) through the Utah State Library’s Pioneer service (http://pioneer.utah.gov/).  The session laws, from 1851 through 2009, are available thanks to the efforts of the Utah State Library in cooperation with W.S. 2010 Model State Administrative Procedure Act

Back on July 28, 2010, we notified readers that the National Conference of Commissioner on Uniform State Laws (NCCUSL) had approved a new Model State Administrative Procedure Act.  Now, NCCUSL has posted the final version of the 2010 Model State Administrative Procedure Act (MSAPA) on the web at http://www.law.upenn.edu/bll/archives/ulc/msapa/2010_final.htm.  NCCUSL adopted the revised MSAPA, subject to style changes, at its 2010 summer meeting.  The final version was posted on October 18, 2010.
