				<content:encoded><![CDATA[<p>Of the 524 bills and resolutions passed during the 2013 General Session, 478 bills have or will become law.  The Utah Administrative Rulemaking Act, at Subsection 63G-3-301(13), requires agencies to file administrative rules mandated by legislation within 180 days of the bill’s effective date.</p>
<p>On 05/14/2013, 392 bills take effect. For these bills, <em>if the Legislature specifically required administrative rulemaking</em>, the agency responsible for the program must initiate rulemaking (file the rule with the Division) by 11/10/2013.  Another 45 bills take effect on 07/01/2013, for which required rules must be filed by 12/28/2013.  Please note that 41 bills provided for an effective date other than 05/14/2013 or 07/01/2013 &#8212; some effective prior to 05/14/2013, and others effective after 07/01/2013.  Rules required by these bills are due 180-days from the effective date of the respective bill.</p>
<p>For example, <a href="http://le.utah.gov/~2013/bills/static/sb0107.html">S.B. 107, Public Shooting Ranges</a>, effective 03/26/2013, provides:</p>
<blockquote><p>The State Armory Board, any state agency, or institution of higher education that operates or has control of a shooting range shall make rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, to implement procedures for use of the range by the public. (Chapter 155, Laws of Utah 2013)</p></blockquote>
<p>Rules to implement S.B. 107 must be filed with the Division by 09/22/2013 to meet the statutory deadline.</p>
<p>The Division encourages agency rulewriters to work with their department&#8217;s administrative rules coordinator to determine which of the 478 bills that passed direct your agency to engage in rulemaking.  Statute provides that if an agency is unable to meet the 180-day deadline, the agency must appear before the Administrative Rules Review Committee to discuss the delay.</p>

				<content:encoded><![CDATA[<p>During the 2013 General Session, the Legislature has passed the following bills that affect rulemaking.</p>
<h3>H.B. 256, Reauthorization of Administrative Rules (Rep. C. Oda)</h3>
<p>H.B. 256, entitled &#8220;Reauthorization of Administrative Rules&#8221;, passed and now awaits the Governor&#8217;s action. H.B. 256 is the legislation required annually by Subsection 63G-3-502(3). The bill reauthorizes all administrative rules except Subsection R592-2-7(2) from the Title and Escrow Commission which addresses Title Insurance Administrative Hearings and Penalty Imposition, Imposition of Penalties. This subsection will be removed from the Utah Administrative Code effective May 1, 2013. A separate notice of the Legislative Nonreauthorization will be published in the May 15, 2013, issue of the Utah State Bulletin. Under the terms of Section 2 of the bill, it takes effect on May 1, 2013.</p>

<h3>S.B. 107, Public Shooting Ranges (Sen. A. Christensen)</h3>
<p>2nd Substitute S.B. 107 as amended, Public Shooting Ranges, passed and now awaits the Governor&#8217;s action. Beginning at line 135, the bill requires the &#8220;State Armory Board, any state agency, or institution of higher education that operates or has control of a shooting range&#8221; to make rules pursuant to the Utah Administrative Rulemaking Act. The bill specifies minimum content of the rules. The bill, beginning at line 163, excludes specified ranges (ranges operated by the Division of Wildlife Resources, the Utah National Guard ranges located at Camp Williams and the Salt Lake International Airport; and ranges owned, operated, or currently leased by a state public safety agency) from the Part, including the rulemaking requirement. Under the terms of Section 10 of the bill, it takes effect upon approval by the governor.</p>

				<content:encoded><![CDATA[<p>Governor Herbert&#8217;s 12/06/2011 executive order requires each &#8220;cabinet level administrator, or other official of similar responsibility, who answers to the Governor&#8221; to designate an administrative rules coordinator. Among other duties, the coordinator must:</p>
<ul>
<li>assess enacted legislation by June 1 of each year to ensure that new regulatory obligations are discovered and met in a timely manner by appropriate rulemaking action; [and]</li>
<li>send a copy of the notice of proposed rule and the rule analysis required by law to the Governor&#8217;s Office of Economic Development&#8230;.</li>
</ul>
<p>The purpose of the provision to assess legislation is to ensure that each state agency has rules in place to implement new statutory mandates. This compliments the requirement found in Subsection 63G-3-301(13) that requires an agency to file a rule specifically required by legislation within 180-days of the legislation&#8217;s effective date.</p>
<p>Regarding the requirement to send a copy of a proposed rule to the Governor&#8217;s Office of Economic Development (GOED): the Division of Administrative Rules, the Governor&#8217;s Office of Management and Budget (GOMB), and GOED have developed an alternative method to provide GOED notices of proposed rules. This method is intended to remove some of the burden from the coordinators. This method involves GOMB forwarding the notice it receives to as an automatic part of the eRules application to GOED.</p>

<p>Related to the Education issue, Education filed an amendment to Rule R277-445 to remove Subsection R277-445-3(B).  That amendment was published in the 3/1/2013 edition of the Utah State Bulletin (see <a href="http://www.rules.utah.gov/publicat/bulletin/2013/20130301/37278.htm">filing 37278</a>).  In addition, <a href="http://le.utah.gov/~2013/bills/static/hb0173.html">H.B. 173</a>, entitled &#8220;Necessarily Existent Small Schools Funding Amendments&#8221;, passed.  This bill inserts language similar to that found in Subsection R277-445-3(B) into statute.</p>

				<content:encoded><![CDATA[<p>Utah Code Section 63G-3-502 requires the Legislature&#8217;s Administrative Rules Review Committee to prepare omnibus legislation each year to reauthorize administrative rules.   At its first meeting of 2013, held on January 22, members of the Administrative Rules Review Committee approved &#8220;Reauthorization of Administrative Rules.&#8221;  The bill, now numbered as H.B. 256, reauthorizes all administrative rules EXCEPT Subsection R277-445-3(B) &#8212; which is part of the &#8220;Standards&#8221; found in Education&#8217;s rule &#8220;Classifying Small Schools as Necessarily Existent&#8221;.</p>

				<content:encoded><![CDATA[<p>Section 63G-3-305 requires each agency to review its rules within five years of each rule’s original enactment, and then within five-year intervals. To comply with the review requirement, the agency must submit a &#8220;Five-Year Notice of Review and Statement of Continuation&#8221; for each of its rules listed below. Otherwise, unreviewed rules expire, become unenforceable, and will be removed from the Utah Administrative Code. Reviews may be filed ANY TIME prior to the deadline.</p>
<p>When filing a &#8220;Five-Year Notice of Review and Statement of Continuation,&#8221; eRules requires that a copy of the rule text (no underlining or strike-out) be attached.  Current rule text in RTF format is available from <a href="http://www.rules.utah.gov/publicat/code.htm">http://www.rules.utah.gov/publicat/code.htm</a>.  You may also contact the Division (801-538-3003) to obtain a current version of a rule.</p>
<p>We strongly encourage agencies *not* to wait until the due date to file a five-year review.  If there is a problem filing on that day, the agency could lose its rule because the deadline was missed.</p>

				<content:encoded><![CDATA[<p>Utah&#8217;s Legislative Administrative Rules Review Committee (ARRC) has scheduled its last meeting of 2012 for Thursday, December 20, 2012, at 9 AM in Room 30 of the House Building on Capitol Hill.</p>
<p>This meeting will include a discussion of &#8220;Reauthorization of Administrative Rules&#8221; draft legislation.  Pursuant to <a href="http://le.utah.gov/code/TITLE63G/htm/63G03_050200.htm">Section 63G-3-502</a>, each administrative rule in effect on February 28 expires on May 1 unless it has been reauthorized.  The statute further requires the committee to prepare omnibus legislation to reauthorize rules for consideration at the annual general session.</p>
<p>The committee will also follow-up on an issue discussed at its October 19 meeting related to Securities.</p>

McAdams recently resigned his seat.  The other three will be leaving legislative service in January  The Division of Administrative Rules acknowledges their estimated combined 63 years of public legislative service to the people of Utah and 27 years of service on the Administrative Rules Review Committee.  We wish President Waddoups, Rep. Newbold, Sen. McAdams, and Rep. Hendrickson success in their future endeavors.</p>

				<content:encoded><![CDATA[<p>The Division of Administrative Rules has scheduled an update to the eRules application.  State agencies use eRules to file administrative rules and that the Division uses eRules to publish administrative rules in the <em>Utah State Bulletin</em>.  The changes in this update are in response to feedback the Division has received.</p>
<p>The update is scheduled for <span style="text-decoration: underline;">Wednesday, November 14 at 10 AM</span>.  Users will be notified before the system is taken down.</p>
<p>This update includes a number of changes that will directly affect rulefilers.</p>
<ol start="1">
<li>The &#8220;Rule Filing List&#8221; that appears on the main screen has been changed.  A check box has been added next to the filter button to allow users to list all filings.  A new column has been added to show the filing effective date, if one has been set.  Column headings have now been enabled as links.  Clicking a column heading link will sort the column content for all filings that appear on the screen.  Filter options have been debugged so that the &#8220;Date Range&#8221; filter no longer conflicts with the &#8220;Year Filter&#8221;.</li>
<li>A form may now be saved as a draft without completing the &#8220;Agency Authorization&#8221; section.</li>
<li>The &#8220;incorporation materials&#8221; fields (box 11) have been changed.  Field names have been clarified to provide better instructions.  For incorporated materials that have a complete date as the issue date, use the &#8220;Date Issued (mm/dd/yyyy)&#8221; field.  For materials that have only a partial date (month and year, or just year), use &#8220;Issue, or version (including partial dates)&#8221; field.  A bug that prevented the &#8220;Add Additional Materials&#8221; button from working properly has been resolved.</li>
<li>eRules now requires rulefilers to use Firefox or Internet Explorer.  DTS developed eRules to work with Firefox and Internet Explorer.  Using other browsers circumvents the edit checks built into eRules that prevent incomplete filings from being submitted.</li>
<li>Content in the &#8220;Attention&#8221; box on the initial screen has been updated.  Support hours have been corrected.</li>
<li>The Notice of Effective Date form has been updated.  In box 3, the field name has been changed to &#8220;Effective Date: (mm/dd/yyyy)&#8221; to clarify the date format required.  The system will not permit the effective date to be entered with hyphens.  In addition, the effective date field now validates that the effective date entered falls within the parameters set by statute (from seven days following the close of public comment through 120 days after publication).  <strong>PLEASE NOTE: </strong> This change to eRules will change the way agencies process effective dates for filings on which they have submitted a Change in Proposed Rule (CPR).  Before this change, the Division asked agencies to make both a Notice of Change in Proposed Rule, and the Notice of Proposed Rule upon which the CPR was based, effective at the same time.  Now, the agency will make only the final Notice of Change in Proposed Rule effective.  The Division will set the effective date for the corresponding Notice of Proposed Rule.  The end result is still the same:  when a change in proposed rule is made effective, all of the underlying filings on which it is based must also be made effective (see Subsection 63G-3-303(1)).</li>
</ol>
<p>The left navigation links have been modified.  Now, an agency rulefiler will see only those filing types the rulefiler is authorized to submit. Other changes that affect the publication side of the eRules application are also included in this update to eRules.</p>

<li>The underlying software on which eRules relies to create the Utah State Bulletin (OpenOffice.org) has been updated.  This resolves several publication production problems.</li>
<li>The output of the Utah State Digest was updated to make formatting consistent throughout the document and minimize editing required prior to distribution.</li>
<li>DTS verified that the e-mail notification functions of eRules will continue to function as the state migrates to Gmail.</li>

<p>On 05/18/2012, the Bureau of Epidemiology filed an amendment to Rule R386-702, Communicable Disease Rule, under <a href="http://www.rules.utah.gov/publicat/bulletin/2012/20120615/36247.htm">DAR No. 36247</a>. This filing was published in the June 15, 2012, Bulletin; a Notice of Effective Date was subsequently filed, making the amendment effective on 08/08/2012. This effective date would have made the amendment to R386-702 part of the September 2012 update to the Utah Administrative Code. However, the amendment was not processed with the rest of the update. The amendment has now been processed and corrected versions of all affected files pertaining to the September update have been posted to the Division of Administrative Rules&#8217; web site. The Division regrets the error.</p>
