H.B. 228 Substituted, Passed

Late the final evening of the session, Sen. Stephenson moved to uncircle H.B. 228 and moved first substitute H.B. 228.  The substitute bill reauthorizes all administrative rules except for the following Sections:

  • (1) R311-201-11, Environmental Quality, Environmental Response and Remediation, Underground Storage Tanks: Certification Programs and UST Operator Training, Work Performed by Licensed Engineers or Geologists; and
  • (2) R311-207-9, Environmental Quality, Environmental Response and Remediation, Accessing the Petroleum Storage Tank Trust Fund for Leaking Petroleum Storage Tanks, Third Party Consultant.

The House concurred with the substitution with only minutes to spare.

ARRC Votes to Amend, Hold H.B. 228

The Administrative Rules Review Committee (ARRC) met at noon on 03/02/2011 to discuss rules from the Department of Environmental Quality, Division of Environmental Response and Remediation.  An audio recording of the meeting is available online at http://le.utah.gov/asp/interim/Commit.asp?Year=2011&Com=SPEADM.  At the conclusion of the meeting, Sen. Mark Madsen moved that Section R311-201-11 and Section R311-207-9 be added as exceptions to H.B. 228, Administrative Rules Reauthorization.

The chairs stated their intention to hold H.B. 228 in the Senate until they receive communication from the Department of Environmental Quality with the “hopeful intention” that the agency responds to the concerns of the committee.  Should the department respond, the bill would proceed to reauthorize all rules.

H.B. 228 Removed from Senate Consent; ARRC Meets on March 2

Sen. Howard Stephenson, Senate sponsor of H.B. 228, made a motion to remove H.B. 228 from Senate Consent and place the bill on the bottom of the Senate 3rd Reading Calendar.  In his presentation, Sen. Stephenson said he had become aware of one rule that the committee may wish to not reauthorize.

The Administrative Rules Review Committee has scheduled a meeting for noon on 03/02/2011 to discuss the issue.

H.B. 228 Passes Senate Committee

On February 24, 2011, the Senate Government Operations and Political Subdivisions Standing Committee gave H.B. 228, Administrative Rules Reauthorization,  a favorable recommendation and placed the bill on the Senate Consent calendar.  That means that the Senate will pass H.B. 228 on March 1 provided no Senator votes against the bill.

H.B. 228, Administrative Rules Reauthorization, Passes House

On February 17, 2011, the House of Representatives passed the annual Administrative Rules Reauthorization bill.  In its current form, the bill reauthorizes all administrative rules.

Administrative Rules Reauthorization Bill Numbered; Reauthorizes All Rules

The annual Administrative Rules Reauthorization bill has been numbered as H.B. 228.  As introduced, it reauthorizes all administrative rules.

Rep. C. Oda (the bill’s sponsor) will present the bill in House Government Operations Standing Committee on Wednesday, January 26, 2011.  The committee meeting begins at 2 PM in room 20 of the House Building, Utah State Capitol Complex.
